Which of these things are “low-level terrorism”?

According to the Department of Defense, “protests.” 

  A written exam administered by the Pentagon labels “protests” as a form of “low-level terrorism” — enraging civil liberties advocates and activist groups who say it shows blatant disregard of the First Amendment.The written exam, given as part of Department of Defense employees’ routine training, includes a multiple-choice question that asks:

“Which of the following is an example of low-level terrorism?”

— Attacking the Pentagon

— IEDs

— Hate crimes against racial groups

— Protests

 

The correct answer, according to the exam, is “Protests.”

Question 1: How, how is speaking out against some policy that is disliked, en mass, but otherwise peacefully, terrorism in any way, shape or form?  Does dissent create terror?  Please explain how. 

Question 2: Does this scare you, as a supporter of the First Amendment?

According to the White House blog by Norm Elsen (Special Counsel to the President on (get this) Ethics and Government Reform), government will now be restricting oral communications on anyone attempting to influence the stimulus process:

“First, we will expand the restriction on oral communications to cover all persons, not just federally registered lobbyists. For the first time, we will reach contacts not only by registered lobbyists but also by unregistered ones, as well as anyone else exerting influence on the process. We concluded this was necessary under the unique circumstances of the stimulus program.

“Second, we will focus the restriction on oral communications to target the scenario where concerns about merit-based decision-making are greatest –after competitive grant applications are submitted and before awards are made. Once such applications are on file, the competition should be strictly on the merits. To that end, comments (unless initiated by an agency official) must be in writing and will be posted on the Internet for every American to see.

“Third, we will continue to require immediate internet disclosure of all other communications with registered lobbyists. If registered lobbyists have conversations or meetings before an application is filed, a form must be completed and posted to each agency’s website documenting the contact.”

(emphasis added) I guess this is what the founders meant in the First Amendment, when they said “No law . . . abridging the freedom of speech except when presented with unique circumstances.“

Flagburning Amendment Up for Debate . . . Again?

Eugene Volokh has the story of Missouri Rep. Jo Ann Emerson, who is apparently now pushing to revive the old, seemingly settled debate on flag dessicration. 

(Just as a quick primer for you non-law geeks: restrictions on flag-burning (other than, of course, those that would protect safety, etc.) were officially invalidated in the 1989 case of Texas v. Johnson, as a violation of the First Amendment.  Although this is usually thought of as a liberal verses conservative issue, the court split somewhat unusually, with Justice Stevens taking the position that flag burning was not protected, and Justice Scalia joining Brennan, Blackmun, Marshall, and Kennedy in the majority’s determination that it was protected speech.)

Representative Emerson’s proposed amendment is: “The Congress shall have power to prohibit the physical desecration of the flag of the United States.”

I’d like to start by saying that I am a radical lover of all things American.  The thought of someone burning a flag sickens and disgusts me; I would be more than happy to go to any person who is burning a flag and exercise my free speech rights by telling them exactly what I think, and it would not be pretty.  But, that is the purpose, the goal, the workings of a free society- we can exchange ideas, even ones that we don’t like, and we all benefit from it. 

Now, certainly if the Constitution were amended, the ruling in Johnson would be null and void, but that does not mean that this proposal is without its problems. 

First, is this really a problem?  My general opinion of government’s role is that it should be basically limited to protecting citizens from having their rights infringed by others.  Obviously, that’s a broad umbrella, but I simply fail to understand who is being hurt, and who would be helped, by solving this “problem.”  If no other flag was burned in this country for the rest of my life, I can’t see how we would benefit. 

Second, Professor Volokh points out that the potential problems with a slippery slope and what he calls “censorship envy,” the idea that if one person or group gets to ban ideas/expressions/symbols that offend them, then others should get to do the same.  As the professor puts it, “The [First] Amendment is a truce: ‘I won’t try to suppress your ideas, if you don’t try to suppress mine.’  And the flag burning amendment risks shattering this truce.”

Third, this idea simply gives more and more support for the dangerous and foolhardy idea that society can ban expressions that it deems “offensive” or “hateful”  and still be free.  It cannot.  Speech and expression must be protected all the more so because they are offensive, and because they are hateful to some.  This is the only way that we can have an open exchange of ideas, and, if those ideas have merit, lead social change.  Those in power, regardless of who they are, will always have an interest in preventing  and suppressing speech that questions their ways, and giving them the opportunity to suggest or claim that the Constitution does not protect that speech is a great way to give them the power to do just that. 

Yes, the flag burning amendment seems to be just a small step in that direction, but it is nevertheless a much larger step than we should be willing to take.  Rep. Emerson stated, in her press release on this topic, that while the First Amendment protects free speech, it offers no protection for “hate speech.”   But, in reality, and misunderstood by many, First Amendment jurisprudence has made absolutely no distinction of that sort, the language of the Constitution gives no reason to believe that it should, and the Supreme Court has never given us reason to believe that it will.  Adding an amendment that builds in an exception to the First Amendment, based only on the offense that the expression brings to others, opens that door, and gives credence to those that, apparently like Rep. Emerson, believe that there are exceptions in the Constitution for actions that violate their feelings. 

If you don’t like flag burning, use your First Amendment rights to make a better case for why the person doing it is wrong.  Don’t use the inherent force of the government to stop ideas that you don’t like.

Is communication that causes “emotional distress” protected speech?

Not according to Rep. Linda T. Sanchez (D-CA), and 14 other representatives, who have proposed the following bill: (ht: Volokh, by way of Reason)

Whoever transmits in interstate or foreign commerce any communication, with the intent to coerce, intimidate, harass, or cause substantial emotional distress to a person, using electronic means to support severe, repeated, and hostile behavior, shall be fined under this title or imprisoned not more than two years, or both….

["Communication"] means the electronic transmission, between or among points specified by the user, of information of the user’s choosing, without change in the form or content of the information as sent and received; …

["Electronic means"] means any equipment dependent on electrical power to access an information service, including email, instant messaging, blogs, websites, telephones, and text messages.

According to Volokh, this proposed legislation is broad enough that it could cover a number of possibilities that go against the very nature of the free speech we treasure, including criticizing politicians in blogs, editorials, etc; complaining and threatening to sue a company that gave you poor service, organizing a boycott, and sending hostile messages to an ex in hopes of making him/her feel bad. 

Makes you wonder what they’re thinking.

In her last column before becoming a functionary in the Obama Administration, erstwhile LA Times columnist Rosa Brooks says:

Years of foolish policies have left us with a choice: We can bail out journalism, using tax dollars and granting licenses in ways that encourage robust and independent reporting and commentary, or we can watch, wringing our hands, as more and more top journalists are laid off or bail out, leaving us with nothing in our newspapers but ads, entertainment features and crossword puzzles.

Something about that idea (subtle hint in emphasis) worries me a bit.

Is the “Free” World Taking on the Islamic World’s Model for Speech?

Jonathan Turely at the Washington Post has a fascinating- and terrifying- article on freedom of speech in countries that should be our allies for the cause:

Among the new blasphemers is legendary French actress Brigitte Bardot, who was convicted last June of “inciting religious hatred” for a letter she wrote in 2006 to then-Interior Minister Nicolas Sarkozy, saying that Muslims were ruining France. It was her fourth criminal citation for expressing intolerant views of Muslims and homosexuals. Other Western countries, including Canada and Britain, are also cracking down on religious critics.

Emblematic of the assault is the effort to pass an international ban on religious defamation supported by United Nations General Assembly President Miguel d’Escoto Brockmann. Brockmann is a suspended Roman Catholic priest who served as Nicaragua’s foreign minister in the 1980s under the Sandinista regime, the socialist government that had a penchant for crushing civil liberties before it was tossed out of power in 1990. Since then, Brockmann has literally embraced such free-speech-loving figures as Iranian President Mahmoud Ahmadinejad, whom he wrapped in a bear hug at the U.N. last year.

The U.N. resolution, which has been introduced for the past couple of years, is backed by countries such as Saudi Arabia, one of the most repressive nations when it comes to the free exercise of religion. Blasphemers there are frequently executed. Most recently, the government arrested author Hamoud Bin Saleh simply for writing about his conversion to Christianity.

While it hasn’t gone so far as to support the U.N. resolution, the West is prosecuting “religious hatred” cases under anti-discrimination and hate-crime laws. British citizens can be arrested and prosecuted under the 2006 Racial and Religious Hatred Act, which makes it a crime to “abuse” religion. In 2008, a 15-year-old boy was arrested for holding up a sign reading “Scientology is not a religion, it is a dangerous cult” outside the organization’s London headquarters. Earlier this year, the British police issued a public warning that insulting Scientology would now be treated as a crime.

So says New York City Councilman Charles Barron, speaking of the audacity of two local restaurants that have, quite  ridiculously, decided to rename themselves Obama Fried Chicken (in Brooklyn) and Obama Fried Chicken and Pizza (in Harlem). 

Now, fortunatly, the councilman is only stating that he will organize demonstrations- perhaps not the best use of his time (and I can at least hope that he is doing this on his own time, rather than using city resources with regards to his role as a councilman), but well within his rights. 

I link mainly because of the so often heard statement to the effect of “Free speech doesn’t give you the right . . .,” when, most of the time, this being no exception, Free Speech most certainly does give that right and more.  Just because it offends you, doesn’t mean that it isn’t protected by the First Amendment.  A word to the wise.

Internet Freedom: Bringing together the likes of Mother Jones and Jules Crittenden

Hot Air has the story of the Cybersecurity Act of 2009, S.773, sponsored by Jay Rockefeller (D-WV), Bill Nelson (D-FL), and Olympia Snowe (R(ino)-ME).  This bill would allow the executive branch of the government to shut down internet traffic in “the interest of national security.”  “National security” as defined by . . . the government.  Feeling threatened yet? 

According to Mother Jones,

The Cybersecurity Act of 2009 (PDF) gives the president the ability to “declare a cybersecurity emergency” and shut down or limit Internet traffic in any “critical” information network “in the interest of national security.” The bill does not define a critical information network or a cybersecurity emergency. That definition would be left to the president.

The bill does not only add to the power of the president. It also grants the Secretary of Commerce “access to all relevant data concerning [critical] networks without regard to any provision of law, regulation, rule, or policy restricting such access.” This means he or she can monitor or access any data on private or public networks without regard to privacy laws.

Here’s the questionable section:

SEC. 14. PUBLIC–PRIVATE CLEARINGHOUSE.

(a) DESIGNATION.—The Department of Commerce shall serve as the clearinghouse of cybersecurity threat and vulnerability information to Federal government and private sector owned critical infrastructure information systems and networks.

(b) FUNCTIONS.—The Secretary of Commerce—

(1) shall have access to all relevant data concerning such networks without regard to any provision of law, regulation, rule, or policy restricting such access; …

SEC. 18. CYBERSECURITY RESPONSIBILITIES AND AUTHORITY.

The President— …

(2) may declare a cybersecurity emergency and order the limitation or shutdown of Internet traffic to and from any compromised Federal government or United States critical infrastructure information system or network; …
